The ubiquitous nature of social media has made it an unrivaled source of evidence.  Particularly in the areas of criminal, personal injury, employment, and family law, evidence from social media has played a key role.  However, the use of social media evidence is not only limited to these areas.  Businesses of all types are affected by social media both in the duty to preserve social media contact and in the desire to access relevant social medial evidence in litigation.

This seminar addresses forensic collection as it pertains to Social Media Data. In keeping with the Electronic Discovery Reference Model (EDRM) we will focus on the preservation and collection of electronically stored information (ESI) from Social Media sources in anticipation of litigation or for internal investigation. This course will emphasize:

•    The Definition and Value of Social Media Data
•    Possible Sources of Social Media Data
     (including Facebook, LinkedIn and Twitter)
•    Public v. Private Social Media Data
•    Issues & Obstacles related to Collection of
     Social Media Data

Ultimately, this program will better prepare law firms and in-house counsel to minimize risk and cost while maintaining defensibility and ethical obligations in the identification and collection of electronically stored information from Social Media Sources.
